Terms of Service

1. Agreement

These Terms of Service ("Terms") govern your access to and use of the Stay Tantra marketing website and cloud hospitality management platform ("Services") operated by Rohitwebco ("we", "us", "our").

By accessing our website, requesting a demo, or using the platform under a client subscription, you agree to these Terms. If you are using the Services on behalf of an organization, you represent that you have authority to bind that organization.

2. Services overview

Stay Tantra provides software for hotel operations, restaurant operations, guest QR ordering, guest stay experiences, billing, and related hospitality workflows. Services are offered on a subscription basis with managed onboarding unless otherwise agreed in writing.

3. Account access and eligibility

Platform access is provisioned by Stay Tantra Operations after scoping, agreement, and onboarding. There is no public self-signup for production tenant environments.

• You must provide accurate information during onboarding and keep account details current.
• You are responsible for safeguarding login credentials and for activity under your account.
• You must ensure staff users comply with these Terms and your internal policies.

4. Acceptable use

You agree not to misuse the Services. Prohibited activities include:

• Violating applicable laws or third-party rights.
• Attempting unauthorized access to systems, accounts, or data.
• Interfering with platform security, availability, or performance.
• Uploading malicious code or using the Services to distribute spam or harmful content.
• Reverse engineering or copying the platform except as permitted by law.
• Using the Services in a manner that harms guests, staff, other clients, or Stay Tantra.

5. Client data and responsibilities

Clients retain ownership of operational data entered into their tenant environment. You are responsible for the accuracy, legality, and appropriateness of data you and your users submit — including guest, staff, reservation, and order information.

You must obtain any consents required to collect and process personal data through guest portals, QR ordering, and stay experiences.

6. Subscriptions, fees, and trials

Access to platform modules is governed by your subscription plan, billing cycle, and commercial agreement. Fees, trials, discounts, and add-on charges are as quoted during sales and onboarding.

We may suspend or limit access for overdue payments or subscription expiry, subject to notice periods configured in the platform.

7. Intellectual property

Stay Tantra, its software, branding, documentation, and website content are owned by Rohitwebco or its licensors. We grant clients a limited, non-exclusive, non-transferable right to use the Services during an active subscription.

You may not copy, modify, distribute, or create derivative works of the platform except as expressly permitted.

8. Confidentiality and security

Each party agrees to protect confidential information received from the other. We implement reasonable safeguards for platform data, as described in our Privacy Policy.

9. Disclaimers

The Services are provided on an "as is" and "as available" basis to the extent permitted by law. We do not warrant uninterrupted or error-free operation. Hospitality operations remain your responsibility — Stay Tantra is a tool to support your workflows, not a substitute for professional judgment or compliance obligations.

10. Limitation of liability

To the maximum extent permitted by law, Rohitwebco shall not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, data, or goodwill arising from use of the Services.

Our aggregate liability for claims relating to the Services shall not exceed the fees paid by you for the Services in the twelve months preceding the claim, unless otherwise required by applicable law.

11. Termination

Either party may terminate per the commercial agreement. We may suspend access immediately for material breach, security risk, or unlawful use. Upon termination, access to the tenant environment may be disabled according to contract and data export provisions.

12. Governing law

These Terms are governed by the laws of India, without regard to conflict-of-law principles. Courts in Mumbai, Maharashtra shall have exclusive jurisdiction, subject to applicable mandatory consumer protections.

13. Changes

We may update these Terms from time to time. Material changes will be indicated by updating the effective date. Continued use after changes constitutes acceptance.
